Commerce Bank is the latest regional bank to be named as a defendant in a class-action lawsuit regarding overdraft fees.
A Florida law firm with between 30 and 40 similar cases active in other courts filed suit on behalf of a Blue Springs woman against Commerce Bank, seeking more than $5 million for class members who allegedly have been deceived by nuances in the bank’s automated account software that can tack on hundreds of dollars in overdraft charges.
The suit was filed April 6 in the U.S. District Court of Western Missouri, one day after a similar lawsuit was filed against UMB Bank on behalf of a Cass County man making similar allegations.
Commerce Bank did not return a call for comment on this story. Todd Ruskamp, a lawyer with Shook Hardy & Bacon LLP representing Commerce, also did not respond to a request for comment.
